These Terms of Use govern your use of tdana.com (the “Site”), operated by the Transload Distribution Association of North America (“TDANA”), a nonprofit trade association. By using the Site you agree to these terms.
1. Use of the Site
You may use the Site for lawful business and informational purposes. You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping or bulk-copying the Member Directory or Transload Rail Dashboard, or using member contact information to send unsolicited bulk messages.
2. Member accounts
Some areas are for members only. You are responsible for keeping your login credentials confidential and for activity under your account. Tell us promptly at info@tdana.com if you believe your account has been used without permission.
3. Memberships and payments
Membership dues, conference registrations, and other purchases are described on the relevant Site pages at the time of purchase. Conference registrations are subject to the Conference Cancellation, Refund, and Substitution Policy published on the Conference page.
4. Directory and member content
Information in the Member Directory and Transload Rail Dashboard is provided by members. TDANA does not verify it and does not endorse or guarantee any member, facility, or service. By submitting content, members give TDANA permission to display it on the Site and in association materials.
5. Intellectual property
The TDANA name, logo, and Site content are owned by TDANA or used with permission. You may not copy or reuse Site content for commercial purposes without our written permission, except for sharing links and brief excerpts with attribution.
6. Antitrust
TDANA complies with antitrust and competition laws. The Site and TDANA events may not be used to discuss or coordinate pricing, rates, bids, allocation of customers or territories, or other competitively sensitive matters.
7. Third-party links
The Site links to sites TDANA does not control. TDANA is not responsible for their content or practices.
8. Disclaimers
The Site and its content are provided “as is” for general information. TDANA makes no warranties about accuracy, completeness, or availability, and the content is not legal, financial, or engineering advice.
9. Limitation of liability
To the fullest extent permitted by law, TDANA and its directors, officers, volunteers, and staff are not liable for indirect, incidental, or consequential damages arising from use of the Site.
10. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
11. Changes
We may update these terms by posting a new version on this page. Continued use of the Site after a change means you accept the updated terms.
